Kolkata Mayor Announces Ban on Future Terrace and Basement Constructions

The Kolkata Municipal Corporation (KMC) will no longer permit construction on terraces and in basements, the Mayor announced on Wednesday. This declaration came alongside the release of a new Standard Operating Procedure (SOP) for restaurants, pubs, and other businesses currently operating from rooftop spaces. Mayor, also the urban development minister, clarified that a new circular has been issued, explicitly stating that no permanent or temporary structures will be permitted on building terraces.

"We've found several cases where rooftop restaurants and restobars were set up after the terrace was either sold or leased. This practice will no longer be tolerated," said Mayor. He further added that similar restrictions would apply to basements, which are officially designated for car parking only. "Converting basements for commercial or other uses is strictly prohibited," he emphasized.

The civic authority sought legal opinion after four rooftop establishments moved the Calcutta High Court, challenging KMC's actions. The legal department clarified that rooftops are shared property among all residents or occupants of a building. Any form of construction—whether temporary or permanent—requires unanimous consent from the stakeholders.

The newly issued SOP aims to streamline regulatory oversight on existing rooftop establishments. Since the matter involves multiple government bodies—including KMC, the fire department, excise officials, and Kolkata Police—the mayor mentioned that a comprehensive hearing process is being planned. "We are working to ensure coordination among all concerned departments to address pending notices and grievances fairly and effectively.

Amid growing concerns from the hospitality sector, representatives from the Hotel & Restaurant Association of Eastern India met the mayor, requesting partial reopening of rooftop venues. They appealed for at least 50% of rooftop space to be allowed to operate temporarily, as many businesses remain shut.

However, Mayor said that the issue is currently under judicial review and hence, no commitments can be made until the court delivers its verdict.
